    Hello Guys,

    Does any one here has Newark NJ as their ASC? Reason is my notice date is august 27th from TSC and I haven't received my FP notice yet. My wife has the similar issue as well. I've called USCIS atleast twice but they are not ready to open service request and are saying that the ASC must be busy.

    I wanted to find out if any one of you here has notice date after august 27th and have already got FP notice from Newark (NJ) ASC.

    Please title your threads appropriately. Your thread title was "Newark NJ ASC". What does it mean? I have corrected it.

    It not only is easy on other people's eyes, but you would do yourself a favor and draw more responses to questions you have if you ask the question in titles because the title appears on the homepage and seen by around 600-1000 people at any time.

    Everyone, despite requests, people start new threads titled :"Please help" or "RFE" or "Question" or "140" or "I485".

    What is so difficult about framing a short question and putting it as thread title?

    Currently on H1B 8th year extension which will expire on 25th June, 2009.

    Labor PD: 9th August, 2004
    Labor cleared: 11th September, 2007.
    I-140 (approval pending) filed on 4th October, 2007. Received at USCIS on 5th October, 2007.
    Can’t file for I-485 since the EB3 date for India is unavailable.

    There is a high chance that I might be laid off at my current employer in the next 2-3 weeks.

    Can I transfer my H-1 upto June 25th, 2009 (or later) as well as start a new PERM case in EB2 category?

    In case of the above H-1 transfer, will the new H-1 be valid for 1 year from the filing or will it be upto 25th June, 2009?

    What are my other options not to go out of status or leave the country?


    As you have I-140 pending (from Employer A), you are eligible for 1 year H1-B with any employer.

    Please check with your attorney.

    NEBRASKA is currently processing 485 submitted as of Sep 26 2006 which means the backlog is of 1 yr 9 months.....

    You have been current for a long time based on your profile.. did you check what is the status of your I485 application


    Status is still initial review on 485 and when checked with infopass I was told that my case in in extended review.

    And yes, my case is current from last 10 months.

    I have EB2 i-140 approved with PD Dec. 05. I am planning to change the employer.. was just waiting to see if CIR gonna help.. but looks like its not. If I change job now, I will have to do labor, i140 once again!! might be able to maintain PD. .. my question is... I believe that in Octo. 06, new quota for GC will be available. What are the guesses that the PD will become current (at least for Eb2 India) in Octo 06?? Some educated guesses are highly appreciated.

    if changing Employer is benificial to you in any way -- financially or peace of mind,, go for it,
    save more and keep options open ...

    DO NOT RELY ON GC PROCESS!!

    I posted this question sometime back since I am in the same situation. I did get some response back and you are in the right track. On this issue, the regulations are very unclear. So far I have not found anything that says we can transfer to a new employer on 7th year and gain 8th year with them. AC21 allows H1B portability but unclear when it comes to 7/8th year. In my oppinion, safest way to go thru this issue is to apply for remaining 7th year and 8th year extension, 6 months before the 7th year expires. My new employer will only hire me only if 8th year gets approved since this will allow them to file for the new GC thru PERM. I did talk to couple lawyers but Mr. Micheal Khosla (http://www.usimmigration.net/index.html) is very confident & clear about this issue. Plese check his website for other informations. I hope I am being helpful here and please let me know how things work out for you.

    Actually, I don't think there really is a ROW is there? Isn't it just that 193 country columns isn't practical.

    actually as and when a country hits the 7% per-country limit or in general becomes a big consumer of visas, it gets its own column.

    China for instance has been in and out. In 1999 it was its own column, became part of ROW in 2002 and now again has its own column:

    Dilip,
    In all your comments, you said nothing of your PD or EB category or your country of birth for that matter. It is difficult for anyone to quell your anxiety without that information. Check with your (or any) immigration attorney for a more substantial answer.

    The bottom line is that a visa number should be available when it comes time to adjudicate your case, meaning that your PD should be current at the time the officer picks up your case AND a visa number available for him/her to assign to you (and your dependents, if you have any).

    Else, the I-485 processing date means nothing, as has been stated by other members earlier. Yes, retrogression sucks!

    The First Part of The COBRA Stimulus Plan: Reduced Premiums

    The COBRA stimulus plan basically has two parts. In the first part, The COBRA stimulus plan will be able to step in and help struggling families trying to pay their COBRA benefits. People who are currently enrolled in the COBRA plan will get a 65% reduction in their premium costs. This will be a huge savings to many families struggling to keep their COBRA benefits.

    Part 2: The Ability to Re-Enroll into COBRA

    The second part of the COBRA stimulus plan will provide recently unemployed people the ability to re-enroll into the COBRA plan, even if they had denied coverage in the past. This will help a great amount of people who choose not to continue their health insurance through COBRA because they just could not afford it.

    9 Key Details about the Cobra Stimulus Plan

    1. Valid for people who were involuntarily terminated between September 1, 2008 and December 31, 2009

    2. To be eligible annual income cannot exceed $125,000 for a single person and $250,000 for a couples

    3. 65% of existing COBRA premiums will be subsidized by the U.S. Treasury Department

    4. Subsidies will be available for up to 9 months

    5. If you declined COBRA coverage after September 1, 2008 you will have the option to re-enroll into COBRA with the above subsides

    6. Notices of the COBRA subsidies and re-enrollment information will be sent from the COBRA administrator (usually your previous employer)

    7. Subsidies will be paid, via a refundable tax credit, directly to the COBRA administrators

    8. Subsidies will terminate if the enrollee acquires a new health insurance plan through another employer or is eligible for Medicare

    9. Subsidies will only apply to COBRA premiums paid after the effective date of February 17, 2009 and there will be no refund of premiums prior to this date
